14. WHERE TO SUBMIT AN APPLICATION FOR THE TYPE APPROVAL OR FOR THE CHANGE OF THE DECISION OF TYPE APPROVAL OF A MEASURING INSTRUMENT: 

 


 

 For a type approval may apply:

 
  1. manufacturer - natural or legal person or an organizational entity not having legal personality, which designs and manufactures measuring instruments, or for which the instrument is designed or produced for the purpose of placing it on the market or use under its own name or mark;
  2. authorized representative - natural or legal person or an organizational entity not having legal personality, established in the territory of European Union Member State or Member States of the European Free Trade Association (EFTA) - Parties to the European Economic Area, as authorized by the manufacturer in writing to act on his behalf.

 
The following types of measuring instruments shall be subject to type approval:
 
Instruments for measuring volume:
  1. fixed storage tanks for liquids other than water;
  2. road measuring tankers;
  3. metal barrels:

instruments for measuring traffic parameters:

  1. instruments for measuring the speed of vehicles in traffic:
    a)      radar,
    b       laser,
    c)      control speedometers;
  2. record sheets for recording equipment in road transport – vehicle tachographs;
  3. recording equipment in road transport – vehicle tachographs;  
instruments for measuring density:
  1. oscillatory type density meters for measuring liquid density within the range from 450 kg/m3 to 2000 kg/m3;
  2. instrument for measuring of the standard mass per storage volume of grain:
    a)       usable 20 L, 1 L i ¼ L,
    b)       standard 20 L;
  3. glass areometers – alcoholometers and alcohol hydrometers;
instruments for measuring pressure:
  1. tyre pressure gauges for motor vehicles;
instruments for measuring weight:
  1. weighbridges for weighing vehicles in motion;
instruments for measuring acoustic quantities:
  1. sound level meters.

 
An application for the type approval of a measuring instrument should include the following:
 
  1. name of the manufacturer of a measuring instrument, its registered office and address;
  2. correspondence address, if different from the address referred to in item 1;
  3. Tax Identification Number, if applicable;
  4. number in the Business Register (number in the National Court Register or in the business activity register), if applicable;
  5. identification data of the type of measuring instrument;
  6. name and trademark of the measuring instrument, if applicable;
  7. intended use and assumed period of use of the measuring instrument;
  8. metrological characteristics of the type of the measuring instrument;
  9. a list of elements of the measuring instrument, if it consists of more than one element;
  10. a list of additional devices which may form a part of the measuring instrument;
  11. specification of rated conditions of use of the measuring instrument, taking into account its version, if provided;
  12. a list of annexes;
  13. date and place of preparing the application;
  14. signature of the applicant
 The application shall be made in Polish, or it shall be attached the translation into Polish made by a certified translator and shall be addressed to the President of the Central Office of Measures.

 


 

 The application for type approval shall be attached by:

 
  1. technical-construction documentation of the type of the measuring instrument;
  2. instruction manual and additional documents certifying metrological characteristics, if they are necessary for proper performance of the test of a given type of measuring instrument and were specified in the provisions defining the detailed scope, ways and methods of carrying out examinations and checks during legal metrological control of particular types of measuring instruments;
  3. a copy of the National Court Register entry or a certificate from the business activity register, obtained not earlier than 3 months before the date of submitting the application, and in the case of an applicant with the registered office outside the Republic of Poland, a copy of an entry in the register kept in the country of the applicant’s register office;
  4. power of attorney to act on behalf of the manufacturer in any matters connected with type approval, if the applicant is an authorized representative;
  5. other documents specified by applicable provisions, referred to in point 2.
 
The applicant shall attach to the application one specimen of the measuring instrument representing the type to be approved, its elements, additional devices and additional equipment required to carry out the type test, or
indicate in the application the place of installation of the specimen of the measuring instrument representing type, if according to the provisions defining the detailed scope, ways and methods of carrying out examinations and checks during legal metrological control of particular types of measuring instruments, the type examination of this type of measuring instrument shall be carried out in this place.
 
The applicant may attach to the application the reports with results of examinations carried out by competent metrological institutions or laboratories, indicating that the type of the measuring instrument meets the requirements.
In that case, the applicant shall submit a copy of the measuring instrument representing type to be approved and its elements, additional devices and additional equipment if the President considers it necessary to carry out a type examination and asks the applicant to submit them.
 
According to the Act of 16 November 2006, on stamp duty (Journal of Laws No. 225, item. 1635, as amended) from the 1st of January 2007 for granting a power of attorney to the applicant is required to pay stamp duty and submit the proof of this charge. The obligation is incumbent on the principal, plenipotentiary, entrepreneur or proxy. Tax authority of competent jurisdiction in matters of stamp duty on official acts performed by the Central Office of Measures is: Srodmiescie District City of Warsaw, 43 Nowogrodzka street, 00-691 Warsaw, account no: 60 1030 1508 0000 0005 5001 0038.
The rate of stamp duty for granting a power of attorney is 17.00 PLN.

 


 

 The technical-construction documentation of the type of measuring instrument shall include at least the following:

 
  1. a description of:
    a)    construction and operation of the measuring instrument,
    b)    security features that ensure proper operation of the measuring instrument, if applicable,
    c)    control or adjustment devices, if applicable,
    d)    places on the measuring instruments assigned for placement of verification marks and sealing marks, if applicable;
  2. overall drawings of the measuring instrument and, if necessary, the detailed structural drawings of basic elements, assemblies and circuits of the measuring instrument;
  3. diagrams explaining the operation of the measuring instrument and, if necessary, photographs;
  4. descriptions and explanations of drawings and diagrams;
  5. software description, taking into account clear identification of the software version used and all the aspects of its security, if it is to be used.

 Type approval decision may be changed:

 

at the request of the manufacturer or authorized representative, in case of modification of the measuring instrument or the introduction of additional elements to it, if they influence or may affect:

  1. the results of measurements,
  2. the conditions for proper use, or
  3. the technical conditions of use of these instruments,

after completion of the necessary re-examination of the type.

 


 

  Type approval decision may be issued with restrictions in particular to:

 
  1. the number of measuring instruments allowed to be placed on the market,
  2. the obligation on applicant to inform measures administration authority about the installation location of the instruments or
  3. the scope of use,
in case, when in a given type of measuring instrument were applied new technical solutions, not yet covered by the requirements.

 


 

 An application for a change of type approval decision or a decision on type approval with restrictions shall include the following:

 
  1. name of the manufacturer of a measuring instrument, its registered office and address;
  2. correspondence address, if different from the address referred to in item 1;
  3. Tax Identification Number, if applicable;
  4. number in the Business Register (number in the National Court Register or in the business activity register), if applicable;
  5. identification data of the type of measuring instrument;
  6. name and trademark of the measuring instrument, if applicable;
  7. identification data of the decision to be changed;
  8. an indication of the scope of the requested changes together with the justification.
  9. a list of annexes;
  10. date and place of preparing the application;
  11. signature of the applicant.
 The application shall be made in Polish, or it shall be attached a translation into Polish made by a certified translator and shall be addressed to the President of the Central Office of Measures.
To the application shall be attached documentation of modifications introduced to the measuring instrument or new elements added to the instrument which affect or may affect measurement results, conditions for proper use or technical conditions of use of this instrument.
The applicant shall present a copy of the measuring instrument representing modified type and its elements, additional devices and additional equipment, if the President of Central Office of Measures asks the applicant to submit them.
In case of other documents attached to the application shall apply according to the regulations related to documents for type approval application. 

 
Period of validity:
 
  1. of the type approvaldecision equals ten years, unless separate provisions state otherwise, and may be extended for another 10-year periods;
  2. of the type approval decision with restrictions shall not exceed two years and may be extended for not more than three years;
  3. may not be extended if the requirements changed and the type approval decision cannot be granted under the changed regulations;
  4. in case it has not been extended, the type approval is considered to be valid for measuring instruments already put into use.

 
President of Central Office of Measures, by way of decision, may withdraw the type approval if:
 
instruments constructed in accordance with the approved type have defects affecting their intended use.
President of Central Office of Measures may withdraw the type approval decision if it finds that:
  1. the instruments placed on the market or put into use are inconsistent with the approved type, or do not meet the requirements;
  2. restrictions in the type approval decision are not observed.

 
Suspension of proceeding on the decision of the type approval:
 

The applicant may request to suspend the proceeding on the decision of the type approval. The applicant during a period of 3 years from the date of suspension may request to continue with suspended proceeding. If within 3 years from the date of suspension the applicant had not requested to continue with suspended proceedings, the type approval application shall be deemed withdrawn.

 


 

 Fees payable for the services of weights and measures administration authorities related to issuing the type approval decision:

 
The fees payable for services:
  1. related to granting or refusing to grant to measuring instrument the type approval shall be calculated as the product of multiplication of the hourly rate, equal to 200,00 PLN, by the number of hours taken to provide the service;
  2. related to changing decisions relating to the measuring instrument type approval shall be calculated as the product of multiplication of the hourly rate, equal to 100,00 PLN, by the number of hours taken to provide the service. Each started hour shall be counted as a full hour.
If additional costs arise during the provision of services mentioned above, these costs shall be added to the fee for the service.

 Application for the type approval or the change of type approval, with documentation attached, shall be submitted to Central Office of Measures, 2 Elektoralna street, 00-139 Warszawa, postal address: Central Office of Measures, 2 Elektoralna street, 00-950 Warsaw P–10.

 

RECEPTION DESK (Punkt Obsługi Klienta - POK) in the Central Office of Measures will receive the application, documentation or specimen of measuring instrument representing type.
